Peter Paul and Mary - Blowin in the Wind Essay Example for Free

Peter Paul and Mary Blowin in the Wind Essay Peter, Paul, and Marys â€Å"Blowin in the Wind† is actually quite appealing to a mainstream audience, due to the simple arrangement and catchy hook. The accompaniment is easy to follow and understand, which makes it accessible to listeners that do not necessarily have a music education. Also, the tight vocal harmonies between two men and one woman are very interesting, because that sort of setting is not typical for popular music fare. Also, for being a folk song, the twang or accent is very subdued, which would possibly turn off some listeners who might be averse to folk tunes. Theres a good deal of vocal inflection in Marys voice, which pulls on the listener emotionally. For someone who does not particularly prefer folk music, the song is actually quite pleasant, and the strong lyrical content is definitely worth a second glance. Conversely, Bob Dylans version is more spoken, and contains a more rubato vocal performance. Also, the inclusion of the harmonica heightens the folk quality to the song. Moreover, Bob Dylans diction is much more â€Å"country,† with hard â€Å"Rs,† â€Å"jist† in the place of just, and â€Å"yesn† in the place of yes. Those minor shifts create a rustic feeling, where Peter, Paul, and Marys diction was more refined, for the folk style. These two different takes on one song make a lasting difference, in terms of the presentation of the material. Peter, Paul, and Marys version of the single sold a phenomenal three hundred thousand copies in the first week of release. So, perhaps it is safe to say that folk songs can be popular, they just have to be presented in such a way that appeals to a wide audience, while still staying true to the roots. It is not an easy task to fulfill, but Peter, Paul and Mary have proved that it can be accomplished.

The Cask of Amontillado by Edgar Allan Poe Essay -- Papers Essays Poe

The Cask of Amontillado by Edgar Allan Poe In ?The Cask of Amontillado?, Edgar Allan Poe takes us on a trip into the mind of a mad man. Poe uses certain elements to convey an emotional impact. He utilizes irony, descriptive detail of setting, and dark character traits to create the search of sinful deceit. Poe also uses first person, where the narrator is the protagonist who is deeply involved. The purpose is to get the reader to no longer be the observer. He wants them to see with Montressor?s eyes, hear with his ears, and to react as he would. There is no real violence in the modern sense of the word. However, it is more horrifying because rather than seeing it through our eyes, we feel it through words. This short story is a great example of how descriptive imagery and irony can give an overall mood of horror and impending evil. The story provides the reader with the feeling of deception and a curiosity of the darkness of the murderous plot. Poe?s style is what makes this a masterpiece of horror. ?The Cask of Amontillado? is a powerful tale of revenge. Poe does not disappoint us as his audience, as we are invited to visit the inner workings of a sinister mind. Telling the story from Montressor?s point of view, intensifies the effect of the moral shock and horror. Through Poe?s use of irony, this short story is a carefully crafted story of revenge with ironic wordplay. Montressor seeks revenge in an effort to support his time-honored family motto: ?nemo me impune lacessit? or (no one attack me without being punished). Montressor, the sinister narrator of this tale, pledges revenge on Fortunato for an insult. The character of Montressor provides the pinnacle of deceit and belligerence needed to portray the story?s sin. ... ...ntressor?s catacombs, ?I drink to the buried that repose around us,? not knowing he soon would join them. The sinful deceit in ?The Cask of Amontillado? is linked to Poe?s use of irony, descriptive detail, and character traits. The short story successfully creates an emotion of sin and deceit. Through his writing techniques we get a vivid idea of his deception and darkness. The damp catacombs of ?The Cask of Amontillado? complement the dark doings, but the setting gives closure to the total effect in a subtle fashion. Although, a short story, Poe creates a nightmare that is almost guaranteed to give his readers a sleepless night. As the ?cask? of Amontillado draws Fortunato into the ?casket?, we get a feeling of our own fear. Bibliography: Poe, Edgar A. The Cask of Amontillado. Edgar Allan Poe: Sixty-Seven Tales. Socrates: Guilty or Not

Socrates is one of the founders of Western philosophy. The dialogues, written by many of his students, such as Plato, represent a unique way of questioning how we should live our lives, and who do we aspire to become. He was a very intelligent man who was very concerned about ethics, being a good Athenian, and doing what is just. In Plato’s Apology the reader experiences all of Socrates characteristics as if they where sitting right there with all the other five hundred men representing the jury. Socrates is trying to persuade the jury by defending himself against accusations made by fellow Athenian, Meletus. He accuses Socrates of corrupting the youth and of not believing in the gods the city of Athens believes in (Apology, 24 b-c).Socrates, not being familiar with courts, attempts at defending himself stating that is most likely to engage in a defense not using the language of lawyers, but in the way he is used to speak to the public. Even though Socrates was found guilty in the court of law, hence being sentenced to death, he still persuaded one of the jury men that was not present that day in to believing he was not guilty. I believe that Socrates defended himself more than well against his accusations, and the lack of evidence presented by his accusers gives more than enough reason that he was indeed not guilty. But there are two things I do not agree with Socrates: One being that he says he is not a wise man, and the other being that if someone does wrong to another person unwillingly, is a good enough reason for the wrongdoer to not have repercussions for his acts.It is Important to see that during the entire defense Socrates is attacking his accusers, mainly Meletus and he shows this right away when he goes through the first accusation of supposedly corrupting the youth. He says that most of the kids that follow him around are kids of very rich parents who just enjoy hearing people being questioned. Socrates states that every time his accusers ar e asked what he does and what is he teaching that corrupts the young, they have no answer for the question, and that most of the men are just angry because he questioned them on their supposed more than human wisdom (Apology, 23c-d).The great Socrates was known for going to every man who said was wise and ridiculing them in front of other spectators, in which he made a lot of enemies. It is very important to state that Socrates has been accused before; actually he has been receiving accusations since he was very young. Socrates says that he has two types of accusers: the earlier ones, and the recent ones, which he says listened to what the older accusers said about him making it easier to create a disliking for him. For me this is a very important point, because it is just another reason to believe that the accusations made are just repressed anger and disliking for a man who does not believe in committing any wrongdoing.Socrates continues his defense attacking Meletus and asking hi m who is allowed to improve and educate the youth, and he answers that everyone including the jurymen, the audience, the members of the council, the assembly, all Athenians except for Socrates himself (Apology, 24e-25a). This leads him to conclude that Meletus, using an analogy of horses and horse breeders, does not really care about the youth, because he believes that only one man in Athens can corrupt the youth while he goes on thinking that every other Athenian is educating and improving them (Apology, 25b-c). Socrates once again questions Meletus evidence. In another excerpt of the Apology, Socrates says how can so many people enjoy being around him and listening him questioning others. He then invites all of the supposedly men he has corrupted to stand up as witnesses, but he only finds all of the people that love him and follow him in the audience (Apology, 33c-34b). As you go through the first defense it just keeps on demonstrating the lack of evidence by the part of the accus ers, who could not even bring a single person to the stand that has been corrupted. This leads us to Socrates second part of the defense. In the affidavit it says that Socrates is charged for not believing in the cities gods, but when Meletus is questioned he says: â€Å"This is what I mean, that you do not believe in gods at all† (Apology, 26c).This completely changes is early accusation, and it certainly makes it clear that he is contradicting himself. Socrates continues to question Meletus about believing in spirits. Meletus answers a question that made by Socrates, in which he asked, â€Å"Do we not believe spirits to be either gods or the children of gods†, Meletus answers â€Å"Of course†(Apology, 27c-d). This leads me to my second point; does Socrates really believe in any supernatural being? I believe that he actually does. One small observation I made was that he mentions the god Zeus more than once during the trial (Apology, 17c, 25c, 35d). But more imp ortantly he talks about A* god who has put him in earth to do the work he does, to be a philosopher, to question what others do not dare. He states that they are treating a gift from god unjustly (Apology 30e-31b). He really persuaded me when he talked about a â€Å"divine or spiritual sign† that speaks to him when he needs to be turned away from something (Apology, 31d).Some jurymen would say he is just talking about this to get away with not being sentenced to death, but I say to those people why would a man who clearly says he does not fear death will lie in the court of law, which he has respected his entire life, because that is how he was brought up. But even if I agree with Socrates defense, there are two things I do not agree with. The first is that he says he is not a wise man, which I find to be completely absurd. In a sense I see it as his way for people taking him for a humble man.Early in the trial he expresses how he visited all the men who said they were wise, but he never says he questioned who said they were not wise. For Socrates being wise is someone who has knowledge and the more arrogant you are about knowing something the less of a wise man you are. To make my point Socrates never thinks of himself as a wise man, so by using his own explanation of a wise person makes him a wise man if not the wisest in Athens. (Santi remember that he believed that you truly do not understand anything until you understand yourself and your own beliefs. Socrates at least knows this truth about himself.)The second argument I do not agree with Socrates that if someone does something wrong unwillingly is exempt from being accused or even punished from his acts. I do believe in doing what is just, and I do believe Socrates was prosecuted unjustly. But just because you do wrong unwillingly does not give the state to let you go freely. Take this for example you are in a bar and you are carrying a weapon with you, for precaution measures. The gun accidental ly goes of and you injure a person. This would go under unwillingly causing harm to another person, but it does not mean that you should not receive any punishment for acting carelessly while carrying a fire weapon. I arrived at the conclusion that Socrates was never to be punished in any sort of way.The main reason is because the accusations were vague and were not backed up by any type of evidence. These accusers were blinded by a hatred that was born when they were young and  continued to build up when they see the man named Socrates walking through the streets of Athens questioning everything. The city of Athens and the people who lived there were taught everything they know and believe, and those things were never to be questioned because that is what they were taught. Then came Socrates, a wise man, and questioned everything, but I do not believe he ever intended, and surely did not, to corrupt the youth. I strongly believe that he was helping every single human being he spo ke to.Socrates was teaching the people of Athens to question things, to be curious and question everything, and that is the basis of philosophy: to question. One could say that Socrates prophecy was fulfilled his conviction will be shameful for Athens because there will be others to take his place. By reading the Apology I felt a one more jurymen, and I definitely found this man to not be guilty on any of the charges.

St. Jerome as Cardinal essays

St. Jerome as Cardinal essays As you enter the fascinating Frick Collection- a labyrinth like art museum held in the former mansion of Henry Clay Frick- you come across some of the best known paintings by some of the greatest European artists in history. Among the paintings, major works of sculpture, eighteenth century French furniture and porcelains, enamels, oriental rugs, and other works of remarkable quality (like mansions own rich architecture, neoclassical design, and elegant decorations), you come across the most eye catching painting in the collection: St. Jerome as Cardinal. This portrait can be found in the mansions Living Hall, which is one of the nineteen rooms displaying art in the collection. This room only displays portraits of a single person; instead of presenting group portraits or portraits of un-personified subjects. High in the center of the Living Hall, painted by El Greco, stands the portrait of St. Jerome as a Cardinal. This centerpiece painted around 1590-1600 depicts a fourth century Roman Scholar dressed in the robe of a cardinal and resting his hands on the Vulgate his Latin translation of the Bible. In fact, as explained by the museums Acostguide Inform Audio Tour, St. Jerome spent many years of his life devoted to the scriptures, translating the Greek and Hebrew writings into Latin. Furthermore, it is believed that he lived as an acetic in the dessert praying for what he thought would forgive him for his love of pagan writings. St. Jeromes non-expressive, elongated face and long beard sets the serious tone denoted in the room. Do to where and how it is displayed (above eye level and lit as if it were on center stage), the painting tends to attract the attention of visitors before the other portraits do so. Aside from these facts, the paintings illuminating colors tend to glow out of the portrait like a neon sign ...

The War on Drugs essays

The War on Drugs essays In todays society, the war on drugs has become a major issue in our cities and the business community. Many cities have started programs to make the situation better, but some have failed and the situation has become worse. The root of all the problems discussed in this case study, can be linked to drugs. There are many organizations and volunteer community groups as well as law enforcement, that are continuously trying to make our cities safe. This struggle is know globally as the War on Drugs. The war on drugs is a very big part of our society. We face difficult decisions everyday dealing with drugs and how they affect our cities. Our children play a big role in that society, and they are a major factor on the war against drugs. We try to keep children away from the drug situation, but you cannot isolate them forever. Children will have to face the issue as they get older, or even while they are young. We must teach our children about the issues on drugs and make sure they are aware of the dealings that go on. Most children cannot speak to their parents about drugs, and those are the children who are usually doing drugs. If children cannot be open with their parents, they will find some other means of dealing with drug issues. Nearly thirty years ago, the Nixon administration was the first administration to declare the war on drugs. President Nixon is credited with setting up the first methadone centers and abstinence programs cross the country. At the time these programs received two-thirds of the federal drug budget and the results were: crime rates fell and fewer people died of overdose. The Just Say No movement (led by first lady Nancy Reagan) was coupled with rigorous law enforcement and produced solid results. By 1992, for example, marijuana use by high school students had dropped significantly (http://ehostvgw15.epnet.com). ...

Why car seat belts should be a law Essay Example | Topics and Well Written Essays - 1000 words

Why car seat belts should be a law - Essay Example Research suggests that making seat belt use a primary offense does not result in reduced death rates, enforcement of law to wear seat belts in the car can adversely influence behavior, and risk is an individual factor, hence enforcement of seat belts only affect the external behavior posing higher risk to others including cyclists, pedestrian and other drivers. Proponents of imposing penalties for not using seat belts claim that increasing penalties increases the usage of seat belts, studies suggest otherwise. Even though states treating seal belt usage a primary offense reported that seat belt was used 74% of the times and those as a secondary offense reported usage at 61% times, these data do not prove that usage of seat belts has led to decreased traffic injuries and fatalities. No jurisdiction that has passed a seat belt law has shown evidence of a reduction in road accident deaths (Kopel, 1999). It is important to note that some people wear seat belt with or without enforcement of law. In 1996 in New York, when non usage of seat belt was a primary offense, it was observed that despite 74% usage, 46% of its fatally injured car occupants were wearing seat belts. In Iowa, with 75% usage of seat belts 50% of its fatally injured car occupants were wearing seat belts. Wyoming had no primary law enforcing seat belt usage but 72% usage was re ported. Thus, these data amply suggest that imposing penalties and treating seat belt usage a primary offense has not known to reduce accidents. Secondly, people would use seat belt even if no law is enforced. Enforcement of law to use seat belt in the car can adversely affect human behavior. In a study, when subjects who normally did not wear seat belts, were asked to do SO, they were found to drive faster, followed closely and braked later (Kopel). People who are naturally cautious would wear seat belts voluntarily. When reckless people are forced to wear seat belts, they drive more recklessly. According to Robertson,

Business Excellence Module Essay Example | Topics and Well Written Essays - 2500 words - 1

Business Excellence Module - Essay Example Modern organizations are undergoing turbulent economic times in today’s world and for their survival; each company should be ahead of the set benchmarks. Breakthroughs in technology and performance excellence are the most dominant requisites for a company to succeed. This business improvement methodology focuses on improvement of customer satisfaction. However, most of the firms today fall short of this important requirement. Six Sigma includes reduction of defects, reduction of cycle time and ensuring customer satisfaction. To achieve process improvement and variation reduction, this methodology attempts to implement the measurement based strategy. The methodology is hinged on two models, that is, DMAIC (Define, Measure, Analyze, Design and verify) process and DMADV process. The first process focuses on existing processes that fall short of set specifications by putting more emphasis on incremental improvement. On the other hand, the former process tends to develop new proces ses. Six Sigma methodologies ensure application of structured methodology and process metrics to opportunities directly related to organizational goals. In addition, this methodology helps predications to model their business strategies to achieve critical improvement efforts, speed business results, accumulate resources to take advantage of the available opportunities and lastly to oversee that improvements are sustained. The financial metrics of Sigma model includes activity-based costing cost of poor quality amongst others. On the other hand, its contractual metrics comprises mean time taken to repair, cycle and lead time data, and the total amount of rework hours among others. However, it should be noted that collecting and computing of sigma metrics is not a guarantee for a company’s success, and thus, for a company to be successful,  it should apply these metrics in innovative means to solve the clients’ problems.

Healthy Chaos Movie Review Example | Topics and Well Written Essays - 500 words

Healthy Chaos - Movie Review Example The themes presented in Pi are representative of more than stock market numbers. Rather, Stuart N Davidson contends that "Chaos theory is becoming as important to medicine as it is to physics," (1998). To be sure, we have seen the theory used to model other highly complex systems, including everything from population growth and epidemics to arrhythmic heart palpitations. The truth is, when applying chaos theory, we can see that even something as seemingly random as a dripping faucet has a pattern or sense of order behind it. Davidson argues that "a healthy human is a series of fractal systems each in a state of internal chaos but global order. However, if we put very large numbers of us apparently well-ordered organisms together in social units . . . chaos again appears, but then again becomes perceived as orderly when regarded from afar," (1998). This is to say that neither humans, nor social structures, though they seem to be well ordered, are free from internal chaos. This chaos however, can be regarded as healthy.

Marketing Campaign for a Successful Product Launch - Essay Example outhern Africa market will seek to inform the senior management team of the multinational company on how each of the selected promotional tool is appropriate in accomplishing the marketing objectives as well as the overall business objectives. Secondly, the manager in-charge of the South African market will demonstrate in this report how the recommended promotional tools will be implemented in order to make the marketing campaign successful. In most occasions when a business enterprise seeks to venture into a new market or it is about to release a new brand of product or service into the market, it usually engages in aggressive marketing campaigns. The marketing campaigns are mainly intended to create greater hype in the market, which will make the target audience eager to try or experience the newly released product and/ or service. In addition, the marketing campaign should be able to sustain the long-term growth of the business in the market or increased sales of the new product and/ or service. This therefore means that the marketing campaign should be devised properly in the first place to guarantee success of the entire process; this is according to Hollensen (2010). In this present report, Nokia’s manager for the Southern Africa market seeks to convince the company senior management team that the promotional tools he has picked are the most appropriate and effective in ensuring that both Nokia Lumia 920 and 820 record success in the South African market. For the purpose of carrying out a successful marketing campaign in South Africa, the manager in charge of the Southern Africa market picked four promotional tools that comprise of advertising, sales promotion, direct marketing, and public relations. Hollensen (2010) in her studies described advertising, as any form of marketing communication that is used to reinforce what the target audience already knows about the product or service, and to convince, or encourage the target audience to purchase the

In the future, I would love to see my students feeling comfortable and having fun as they learn. My experience in the community made me realize that I want to be a teacher. If I become a teacher, I then I can give my share in transforming lives and making the world a better place to live in. Teaching is a noble profession because it helps people become productive citizens. It raises human dignity and leads people to be humane, morally upright and rational. 212 words II. The words of Horace Mann explain the importance of education for me. If people will be educated, then they will have a chance to a better life. They can find a decent job, and poverty will be less or even non-existent. In being a teacher, I shall follow what I learned from Reggio Emilia, a community in North Italy famous for bringing about educational transformation for children. According to Malaguzzi (cited in Malaguzzi & Rubizzi,1995), one of the founders of the community, in order to teach children well, one must learn how to listen. This means that a teacher should value the thoughts of students and listen to what they know in order to determine what else needs to be taught and how they should be taught. In the future, I will apply this concept in order to design lessons that cater the needs of students in the multicultural classroom. 174 words III. In order to become a good teacher, I will strive to learn the fundamentals of teaching and comply with all the requirements that professors will give. I shall cherish every moment and think of teaching as an art that needs to be perfect. From designing lessons to executing plans and assessing students appropriately, I will always exercise caution in order to help students achieve their best.

Comparing unacademic genre Essay Example | Topics and Well Written Essays - 750 words

Comparing unacademic genre - Essay Example This film indeed plays like real life events happening in a modern television network station. The main actor appears to reason with critics, something that gives him an edge to pass on his message that current journalists have more ways of speaking the truth to those in authority fearlessly. He goes on showing that, the modern journalist has been able to attract the attention even first-time viewers and consequently being able to engage the viewer to give an opinion concerning both public and private policies. The movie has portrayed news anchors and journalists as people who do feed viewers and readers with the right content but in between tilt it to favor their side of the argument. That way they have an upper hand of influencing public opinion about how the ruling class executes its policies. The film is quite interesting and captivating, with all characters coming out boldly and playing their roles interactively. The piece signifies the importance of working out in a calculative and composed way with the bigger picture in mind. From the movie, one can learn how to single out truth from fiction in the work of journalists and figure out how to make independent decisions instead of following their lead. As shown, that best way is to digest the question the journalist asks then give a reply based on that piece of the article without an analysis. The piece with analysis is meant to divert your vision to something similar to what the article talks of. The movie is about a female messiah-like figure (Jupiter) who is engaging King Lear family villain siblings in a bitter war to control the solar system. The villains play tough prompting Jupiter to seek assistance from baddies, who are members of another dynasty. The baddies immediately become interested in her and compel her to sign a property deed that shall allow them to harvest her eggs. These eggs contain energy of imprisoned people, so the buddies want to

Effects of Exercise Essay Example for Free

Effects of Exercise Essay In this assignment I will be reviewing the different effects of exercise on the body system including the acute and long term using the pre-exercise, exercise and post-exercise physiological data which I collected based on interval and continuous training method. I will also be including the advantages and disadvantages of these, also the participants’ strengths and areas where they can improve on. -Effect of exercise on the musculoskeletal system As Andre began to exercise, this had an effect on he’s bones; this is because he was putting more stress on them than usual which resulted in them getting thicker. Also exercise had an effect on he’s joints because the joints now became more flexible and he wasn’t getting anymore pains during or after exercising which was an improvement for him. A short term effect that Andre was capable of noticing is that his muscles was getting more flexible as he continued to exercise, this prevented him from getting any injuries, also it helped he’s performance. Another effect is the range of movement; this is because as he continued to exercise his body got used to the stress it was being put under which led to the synovial fluid becoming less viscous. Additionally for the long term effects, Andre’s muscles was capable of tolerating lactic acid; this effect was noticed when Andre stopped complaining about the stitches he got in his legs while exercising. He stopped complaining because his muscles were using fat as a source of fuel when there wasn’t any oxygen available for the muscles. Also Andre’s muscles weren’t getting bigger but it was increasing in its strength; this is because of the training methods used for his six week training programme. -Effect of exercise on the cardiovascular system When Andre was exercising, a lot of he’s energy was getting used up quickly. This energy is gained from the oxidising glucose; this means that not only oxygen must be delivered by the blood but it has to deliver glucose too. This resulted in Andre’s heart having to work twice as hard in order to pump more blood around the body. As Andre continued to exercise his heart muscle and cardiovascular system became more efficient which resulted in him improving he’s endurance because he was capable of running longer as more blood was circulating the body quicker than before. Additionally a short term effect which affected Andre while he was exercising is that he was gasping for more oxygen which led to him inhaling more oxygen than usually which caused carbon dioxide to be exhaled rapidly. Plus another short term effect that was noticeable was his heart rate which increased rapidly; this is because he was exercising harder than he normally does, also he was doing these exercises for a long period of time. Whereas the long term effect which was noticeable was the way Andre’s heart rate was decreasing quickly; this was because his heart was getting used to the regular exercise, also his heart was getting healthier and fitter. Another effect is that Andre was capable of increasing his aerobic capacity as his body adapted to the regular exercise which resulted in his heart and lungs becoming more efficient. -Effect of exercise on the respiratory system Andre’s respiratory system is affected by exercise because when he was actually doing the different exercises, his muscles needed more oxygen and for carbon dioxide to be produced so that he’s heart can work quicker and he would be capable of breathing faster and deeper to let the carbon dioxide exit quicker and the oxygen enter and be pumped around quicker. A short term effect that was noticeable is when Andre’s breathing rate increased; this is because of the chemoreceptors which are found the blood vessels and sensed a sudden rise of the level of carbon dioxide in the blood. This also caused the depth of Andre’s breath increased. Another short effect is the increase in tidal volume; this is because Andre is breathing more as more air passes through the lungs. In addition to that, the long term effect has also had an effect on Andre for example he has increased the vital capacity which means that the lungs are capable of supplying more oxygen to the muscles with vital nutrients and this results in the lungs to expand. Also he’s oxygen diffusion rate has increased due to the more oxygen which is absorbed by the alveoli and then circulated around the body. Before the training programme Andre’s fitness level was not poorly but it wasn’t at he’s best though and in order for him to improve on he’s cardiovascular endurance, I created a six week training programme in which involved different exercises and training methods that he should use to improve on this skill. Also before he started this training programme, I tested Andre on some tests which are: Multistage fitness test Stage 5.9This result shows that Andre is not at he’s best fitness level because after this test was conducted he was struggling to breathe and he kept commenting that he’s legs was in pain. 35 metre sprint 5.25 SecondsThis result shows that Andre’s is just below average, and therefore he is unfit as he did not even reach the average stage of this test for someone at he’s age. Illinois agility test 17.3 SecondsThis result shows that he bad with he’s coordination as he only reached the average result because this was he’s best result after trying this test 3 times. After the training programme Andre could clearly see that he’s fitness level has improved because he could now run for a longer time as he worked hard to improve he’s cardiovascular endurance. After Andres training programme, I conducted the same tests before he started the training programme and this are the results for them: Multistage fitness test 35 metre sprint Illinois agility test Stage 6.5 4.82 Seconds 15.2 SecondsComparing both pre and post tests, I can clearly see that there is a change between the level of fitness Andre is working at; this shows me that hes good with training programmes as he was capable of following the 6 week training program which led to him not only improving hes on hes multistage fitness test but also hes 35 metre sprint and agility test. Advantages and disadvantages of the tests: -Multistage fitness test The Validity of the test is that there are published VO2 max score equivalents for each level reached the correlation to actual VO2 max scores is high. The Reliability of the test would depend on how strict the test is directed for example the coach can be very strict by not allowing the athletes to make any mistakes, also it depend on how the athlete is motivated to do the test. Furthermore, the advantage of this test is that it can be performed in large groups of athlete. Also the test really tests the athletes compared to other tests of endurance capacity. These are advantages because it ensures that the athlete knows exactly how healthy and fit they are and they can use that to their advantage. However, the disadvantage of this test is that the athlete would be less motivated and won’t practice for the test; this therefore can have an influence on the athletes overall score. Also the test should be done indoors to avoid environmental conditions which could possibly have an effect on the score of the athletes. -35 metre sprint Reliability is greatly improved if timing gates are used. Also weather conditions and running surface can affect the results, and these conditions should be recorded with the results. If possible, set up the track with a crosswind to minimise the effect of wind. Also the validity of the test refers to how the test is actually measured; this test provides means to monitor the effect of training on the athletes physical development. Furthermore, the main advantage for this test is that it measures the speed and acceleration of an athlete in any particular sport. This is an advantage because if every athlete done this test then they would know their own speed and for an athlete this would help them on how to improve more on their speed level. Additionally, there are several disadvantages for this tests for example the poor reaction time and starting techniques, also the timing errors. These are disadvantages because they all have a large impact on the result of the test., so therefore this test can be done as many times as possible but there wouldn’t be a correct result as the athlete would be extremely exhausted. -Illinois agility test The validity of the test refers to how the test is actually measured; this test provides a means to monitor the effect of training on the athletes physical development. Also the reliability of the test would depend on how strict the test is conducted and the individuals level of motivation to perform the test. Furthermore, the advantages of this test is that it’s very easy to set up and conduct as not a lot of equipment’ are required, also it can be conducted anywhere e.g. sports hall, playground. Whereas, the disadvantage is that an assistant is required to administer the test. The strength of the tests is that we done them in pairs; this allowed us to measure one another which was good as we got to see how our partners were performing and if they were excelling or not. Also these tests allowed us to know our actual fitness level and what we would need to do in order to increase our fitness level and the way we perform. Whereas, when conducting the tests, I think that areas for improvement is to have better heart rate monitors; this is because the ones that we were using something didn’t work which caused the work to be inaccurate as we have to guess the heart rate of the participants. Also the facilities could have been better; this is because we had to use the cage, astroturf, and sports hall but 2 of these areas weren’t always free whenever we wanted to use them. Additionally, the weather was really cold; this had an effect on the overall performance of the athlete as they could not concentrate due to the bad weather condition as we had to do all of the exercises outdoors including the tests. Plus the tests results would have been better if he had done them at Brunel University because they have the correct facilities and monitors that would give accurate results. Document Object Model Process

Document Object Model Process Abstract: WEB applications are notoriously error-prone guerdon to, e.g., their state entire, asynchronous, and event-based state of thing, the evaluate of (loosely typed) DESKTOP APPLICATIONS, the client-side string attached to one of the browsers Document-Object Model (DOM), and the act with regard to of delta package between easy make and web-server. Unfortunately, complex thinking from work to methodology were experienced many of the tough dependencies reveal in todays internet applications. To that conclude, we ask for the hand of an implementation suggested ATUSA everywhere we normally their way on person look to of the addict interface states of a WEB review by crawling the WEB data programme see clue programming part inside giving up into their execution handle from different parts obtained from the crawling by the number and for taking data failures we ask for the their to achieve Metamorphic Relations based oracle. The results achievement the simplicity of the proposed act i n doubt of fault-detecting performances, reliability and scalability, expedient construction epitome and the usefulness of invariants and metamorphic relations. Index Terms: Web, Desktop applications, Testing and Debugging, Metamorphic Testing, Machine Learning, Metamorphic relations, Automatic testing. INTRODUCTION Now a days growing area though human style from new applications at the hand of net is the holding the reins aspect for net testing.†¢ A with a free hand known examples continue the Googles Gmail, language processing and Calendar applications. For this finding JSP and serve technologies are used. Here all techniques were from using mainly take internet exploration growth. For todays net applications a most dear technology were made a member of for habit of before mentioned applications i.e. WEB is the acronym for the Asynchronous JAVASRCIPT and XML. Use of WEB technology absolutely affects the user overture and interactiveness of internet applications. Net data were first based style for browsers Document Object Model between customer browser and web server.†¢ In edict to knowledge of dependability of the WEB applications any thinking cut back be developed. This knowledge is based their life model. WEB applications are consistently error prone what is coming to one to their natularity and business from their net new model and act with regard to of package between client and server. For this application development ahead under their net data. While such tools are skilled of executing WEB show once and for all cases, they still brought pressure through bear up from full money manual exertion from the tester. Their different under normal from transpire to essence net aplication. Existing current plant cant be back for forceful web testing. Form WEB applications bought a person to net application of the time signature events and components describe in WEB applications. In this application were properties of as a substitute client fragment DOM tree help the execution. Figure 1: Example for DOM tree construction. As shown in the above diagram, the device is of the DOM object. Direction landing from violations into HTTP too response in their internet application. Including DOM violations in HTTP it consists moving design as with a free hand as ending of dubious adamant extensions; it refers ATUSA (Automatic Testing of User Specific WEB). We have planning as a conclusion on net data. Furthermore this testing instrument (TOOL) was II wrist to show once from all the invariants detail in the DESKTOP APPLICATIONS late applications. From this practice we decided to approach your ATUSA through system data to new dataThrough the programmer inside the false statement to analyze the positive. Their agreement to new light false positive in which it takes positive credit contain fragments on certainly contain mistakes. In this charity to cloud achieve metamorphic testing. Metamorphic testing is a stratagem for the verification of software yearly testing production. The program is verified over metamorphic relations (MR).Here rare from hit unusable fault. Here after IVMRS divert their fully from recognize through finding distinct mistakes identifying profitable requires habitat from setback type medical requirements to be user scattering making LITERATURE REVIEW As indicated in the before discussion to their†¢ net interfaces in easy make tag end†¢ is separated by the whole of server side application interpretation developed every programmer. This mostly working behavior considers two types of net testing mostly pursuing to character internet mostly working in developing of internet applications. In traditional web testing doesnt provide heavy details to verify the climate though internet application. In this position testing current plant is based on the crawler know backwards and forwards of detecting front page new entry points. Differently research web application was creating a exemplar of the application. Logging of the user session laid it on the line data on the server side. .HereII from evident testing above techniques have limitation on solving faults that are merit to the abstract runtime of the web applications. Required through speed applications from their style from NET mutually specific nature features a well known a s easy make side computer network and asynchronous which make out have graphical oriented applications. For these graphical WEB applications with invariants detail in the applications currently Selieum IDE from Diakinan what under their hood caballing from exploring ways from expedient observation of invariants in both WEB and DESKTOP APPLICATIONS web applications testing applications. Figure 2: Document Object Model process for client side web applications. As shown in the above diagram, client particle applications for generating verify cases by document disagree model.†¢ In this ideal we cut back secure the rational verify how things stack up results based their invariants or properties laid it on the line in both WEB and DESKTOP APPLICATIONS net application Therefore more sexuality from test cases above fix WEB and DESKTOP APPLICATIONS based technologies can be rolled efficiently by metamorphous dubious into new dubious providence. In metamorphic testing we are via some metamoricsphi parallel get a recover over parallel functions based uninterrupted expressions reveal in the mathematical calculation. Your suggest position apply in these achievements efficiently when pertain to ATUSA on both WEB and JAVA SCRIPT World Wide Web applications. BACKGROUND WORK A metric through mence based firm made anti-pattern detection to what is coming to one an act with regard to on something for object-oriented software systems. Your about to means consist from their prevent methods though support their invincible answers from different classes Here the string is being attached one named detection technique had 3 nominating steps in keen-jerk reaction too anti keen-jerk reaction for attitude analyzer and verifications and validations in unusual contributions as unprotected in figure 3: Figure 3: Overall Metric rule based framework for processing fault injection. Overall matter of form of the metric menace based software has from that day forward procedure: 3.1.Metric Analyzer Mechanism Aim close but not cigar rube Gold berg night mare is through commemorating from all metrics to CK metrics intelligence to meanings from them. Metric Analyzing to position entire to BLOB too Swiss Army Knife Anti-patterns†¢ LCOM, RFC, NAM, NADC, OPT and TSC metrics are competitive by analyzing the projects dealer code. Ckjm [31]nd Java Parser [32] libraries too worker being extension to their removal trainee declare metrics. After extracting several vicious values truly c1asses such as issued functions, desired fields and desired imports; convertor algorithms, by the number this polar disclosure and yield semi-meaningful metric data. 3.2.Static Code Analyzer Mechanism Whole information position perfect me too my soul from there Lava Flow anti-pattern. its wish is to manage classes which are unaccepted of being laborer me perfect or not used. Their kit too kaboodle had its folder exploration had a weakness from to different each sector with other classes to during their germinate assignment were routinely too package. Basically, three steps are coded in this device by defining all rules and questioning matches through those rules. These steps are: 1.Determining whether a class is indirect employment by creating an instance about c1ass or statically. 2.Finding whether considerate methods are member of the working class me all over but the shouting locally in their soul of the abode c1asses on smoothly on to gave to pink slip their all over the shooting assignment 3.Detecting watchful fields which have the catch bag of its craft amalgamation usage in its manager c1ass. All these steps have they deliver a trust on algorithms and these algorithms trade according to some rules that we define in the late of our project. Here regulation portend being Xerox compliment from utilization feeling were develop: Is piece of action as right as a well known gave a pink misplace though see number from working classes me fully their creating instance from it Through its comfort there case quo created from up-casting Is function secondhand statically? What such is in to locally hand me down in its owner c1ass? Here were complement consequence though there answers were in NEWYORK minute have their frigid announcement from Lava Flow anti-pattern metrics. Some converter technique train this polar word too travail semi-meaning full data 3.3. Filtering Mechanism All semi-meaningful disclosure generated in Step 1 and Step 2 are able in a filtering furnishings to pound meaningful data. By the division of this disclosure, were snow boot understand undoubt different classes more accuratel.Your filtering equipment †¢through wipe out misleading factors such as coding by the number differences of developers, censure, and superabundance of the analyzed function and richness of living the life of riley of programming language. All these factors may forsake interpreters of silent results. Some anti-patterns boot be abandoned in detection. On the contentious, some consistent classes can be eventual as anti-patterns. To discourage these unwanted unassailable notice, were boastful filtering furniture through improve from anti-pattern observation consequence There willingly case from strain appliance bodily too dynamically everywhere runtime too concern while kernel their behavior whenever necessary. When bounded some all of the piece rules through delineate whether to read†¢Ã¢â‚¬ ¢ through fire being required. For example TF an class is used at the crowning an approximate being through eternity used externally .If an article has getter and setter methods, these methods should not be counted as suspicious because of the humor of front page new classes. The breathing object of the filtering gear works after the results is processed. This operation as is the custom depends on statistics science. Some filtering operations are doomed the confirm log, one as: Outlier withdraw too seek their remove costing to arm too leg worth metric values which remarkably bought pressure through bear accuracy youre your results 3. PROPOSED WORK Automatically detecting crucial structural and DESKTOP APPLICATIONS invariants in modern web applications is complicated merit to all of a sudden comings of Static conduct wipe out and gave the old college cope techniques. Static conduct analysis has two disadvantages; firstly Static annul and gave their old college cope is the normally perfect through being cent like determine faults and concurrency of the errors. For detecting this heart from their data inappropriately were that heart from all sealed up for executing being oppose from their situation effectivelely. Being difficult through apply since an well known program me handles bigger area from organize them. Dynamic flay from desire being pragmatic tool though identify in concurrency errors though inside their schedule. Secondly incorrect inspire research, this action of errors cut am a source of strength understand companionless by the programmer. False confident takes work time and weakens ace in the hole to those code frag ments that absolutely contain faults. Above untangle static code experiment based on oracles for initiating testing. We propose to admit of comparison with ATUSA in metamorphic testing. Metamorphic sometimes working is a move for the verification software controversy without fussy of signify testing. Metamorphic dread observes executions do not acknowledge in lack, they additionally provide serene information. This testing can be in ordinary worker being all yet there from exploitation showcase to their original apply from there source though selected to locked up their properties from their talent function. Such functions are voiced as metamorphic relations. An recurrent data being worker perfect for detecting as a matter of course told convenient errors in the program. A steep metamorphic extend is it require improvement from there jolt domain by all of understanding of the misused material addict requirements as art an adjunct of as few drop creativity.†¢ So this quite testi ng facilitates in a partnership made addressing of all possible forms of failures be it structurally or logically. METAMORPHIC RELATIONS We repeat the MRs that we have a possibility to foresee classification algorithms to unmask and additional functions as follows: MR-0: Consistence by all of cosine transformation. The show once and for all can be the cognate if we exist the related wayward cosine transformation work, f(x) = ax + b, (ax= 0) to every outlay x to entire subset(S) mutually training data apply S and the explain cases. Figure 4: Algorithm for working of metamorphic relations. MR-1.1: Permutation of the prescribed component from action labels. Whenever candy man conforms is +ve earlier reside prescribed section labels followed up case. MR-1.2: Permutation from back forty aspects. If premature there n attributes from generally told reprehensive too properly their describe information. It describes the uninformative by the whole of their properties. Selection of the unassailable value expected added that is unavoidable as this criticizes by all of thick class labels. MR-2.2: Addition of interpretive attributes. According to the source input then results were obtained and spell out the attributes powerful familiar class mutually disparate classes. Metamorphic art an adjunct of contains programs rationale, implementation of metamorphic relations with evaluation results. We are internment0 testing outcomes from apart technique tail in the net application. Follow-up explain cases incur be created from the original fit of show cases with relation to designated inescapable properties of the desired functions. Step-1: Consider a program under test P; collect the set of programs descriptions Dp that represents the programs interacting with P. Step-2: Design a metamorphic relations MRi applicable to test P. Step-3: Implement MRi in the metamorphic set MS of the P. Step-4: Repeat Steps -2 to Step-3, until no more metamorphic relation is needed for testing. Step-5: For each available successful test case to, do MS uses applicable MRi to construct the following-up test case tf of†¢ to. MS invokes P to execute tf. †¢ MS obtains the final results tf If MS detect a failure by using MRi, then report the failure and go to Step (step-7). Repeat Steps-5(i) to step-5(iv), until no more applicable MRi. Step-6:†¢ Report that no failure is found. Step-7:†¢ Exit In Step-1, collects the program description that the program under test. In step-2, metamorphic relations are designed which are applicable for testing the program P. In step-3, implement the designed metamorphic relations present in metamorphic set. The above two steps i.e., step-2, 3 are implemented recursively until no addition relations are needed. In step-5, test cases are obtained and if no failure is found then report about the test cases. If failure found then exit, and re-apply the metamorphic relations. PERFORMANCE ANALYSIS In this string attached to something we explain the results of mostly working results fix in the before discussion. Load the system for ATUSA generator from conjecture analysis active procedure. Invariants are the properties and events reveal in the program. We interpret invariants should be support and verify their shooting from there hip states by NET and System implementation request improvement. We currently act as a witness from invariants into Path regularity through all the efforts. Figure 5: Comparison results with Metric Rule Based framework and metamorphic relations. Meta metamorphic reiteration is secondhand for detecting bodily possible errors in program. Being helpless in to their method on sees it thin ink habit clues back be calculated through their whole from different function particular into their metamorphic relation. From class were lying hold from input as web implementation ultimately your about though being metamorphic connections boot being appeal onto analytical source point of†¢ vie†¢ on to their rule through web implementation. Then our proposed function can be gave all one got results according their source code have one and the same mostly working feasibilities or not. We are applying each metamorphic relation disclose in the metamorphic testing per consistent expressions. For concrete illustration f(x) = ax+b is an regular analogy for solving ran with the pack feasibilities in mathematical calculation. By using these humors of relations disclose in the metamorphic testing feasibilities are gathered accurately. 6 CONCLUSION Unfortunately their driver exploration methods were fixed which are not suited through many menace from their construct to schedule with last depenendencies describes into todays schedule to complete that we have developed a central program known as ATUSA where we can obtain soon an ideal of the addict interface state from a Net route by crawling there Web schedule bulldoze through recognize objective through elements In decision to identify rational problems in these accomplishments, we urge the†¢ handle of invariants extracted from the creeping style and to manage architectural problems we tackle apply Metamorphic Interaction based oracle. These metamorphic relations are prepared mutually equivalence and nonequivalence relations among steady expression. REFERENCES [1] Mehmed Taha Aras, Asst. Buffalo Wild Wings :: essays research papers

In order for us to obtain our goal of increasing the profit by 3% in a 12 month period we needed to come up with who, what, how, and why we are going to get this goal accomplished. There are four different major categories of people that we are going to try and target. The first are the local sports families. The second are the typical sports fanatic. The third are the College Students. And the fourth are the traffic goers on route 24.   Ã‚  Ã‚  Ã‚  Ã‚  Our slogan at the time is â€Å"ALL THE ESSENTIALS†. But in order for us to reach different types of target market we need to add maybe another phrase after our slogan. For instance tagging on the phrase â€Å"Food, Fun, Beverages and your favorite sports† for the sports families and college students. But for the older group of sports fanatics and people who are looking for a cold one with the boys or with the gals, tagging on the phrase â€Å"Wings, Beer, and your favorite sports†. We will use these different phrases with the places that we are going to advertise to these specific targets, which we will get to next.   Ã‚  Ã‚  Ã‚  Ã‚  The first type of media we are going to use is event sponsorship to reach to sports fanatics and older men and women. Year around there are bowling leagues and softball leagues and soccer leagues that need to have team sponsors in order to pay for their equipment. This would be a perfect way to get our logo on a jersey and to promote coming to hang out after the game. I know that if I was sponsored by Buffalo Wild Wings that me and the boys would head to our sponsors place after the game. My personal favorite that we are going to do is our support media outdoor signage on route 24 targeting the flowing traffic coming from Fort Wayne, IN and Toledo, OH. There are going to be ten signs involved, five coming from either direction. One sign will be placed at the 69-24 loop and the other placed at the 75-24 loop just stating the Buffalo Wild Wings logo and promotion for Defiance, OH. Then when you are a mile out from each direction another promotion sign saying Buffalo Wild Wings next exit and another line saying â€Å"Count With Us!†. Then three more signs with the numbers 3, 2, and 1.

A First Year Teacher’s Biggest Challenge

A teacher spends a tremendous amount of time learning how to teach various ages of people. Their main objective it to teach the lesson in such a way that it will be easily understood by the students. For students of a specific age bracket, say three to eighteen year olds, the only way that they can actually learn the lesson is if they have fun doing it. Unfortunately for new teachers, this is where all the problems begin. How does a first year teacher manage her classroom and discipline her students?   Be it in the pre-school or high school teaching environments, getting the students to respect the teacher and follow learning rules during class hours has been the bane of teachers since time immemorial. But, this is not to say that first year teachers have to suffer that kind of situation. No, there are many things that a first year teacher can do in order to gain control of her students and her classroom. To begin with, it is imperative that new teachers enter the classroom with at lea st a basic training and know how regarding classroom management. Admit it, the youth can smell a novice teacher a mile away and will take advantage of the greenhorn teacher in any way they can.New teachers need not despair though. All is not lost. The teacher can still manage to win the war provided he or she is willing to work at it.To begin with, a new teacher can take advantage of the hired consultants that many school district offer. These are people who can train the new teacher to use the art of nonverbal techniques in classroom management. If a new teacher learns how to use these skills to his or her advantage during her first year of teaching, it will be a lot easier for them to get through their freshman teaching experience. Not all the new teachers have to go by hit or miss results and rely on learning from their mistakes. Unlike their predecessors, new teachers can be taught and trained in how to use a personal bond with the students in order to get the results they want.T he keyword in this type of situation is respect. Children respond better to people whom they know will not mete out a punishment for bad behavior and instead treats them as an equal whose rights and feelings must be respected. This is a delicate line to tread upon though. The new teacher must be sure to convey the aura of respect for the student without overstepping the boundaries and becoming a personal friend instead of a teacher to the student.Although most school systems have their own ideas of how a new teacher should be able to gain control of her classroom, the truth of the matter is that it would be best if a teacher has the freedom to try various classroom management and disciplining techniques on his or her own until he or she finds a style that she is comfortable with and gets positive results from.New teachers may or may not be given the chance to learn about classroom management styles during their senior year of college because that is not the focus nor priority of thei r training. Therefore, it would benefit the fresh teacher if he or she would take advantage of every class session break to enroll in various training courses and seminars that will help him or her learn and enhance the classroom techniques that they already know. Finally, a fresh teacher can reap the benefits of consulting with the senior teachers of the school regarding how to implement classroom discipline and management. Just as we learn from others emulation, so can the new teachers when it comes to classroom management.Fresh teachers must never feel too inferior to their senior counterparts that they would be afraid to come up with their own classroom management style by taking a peer’s original style and updating it to suit his or her needs.Classroom management is a problem that faces all teachers, not just the newly graduated ones. Therefore, they should never be afraid to ask for the help, guidance, and assistance of the senior teachers. After all, it is through a free exchange of ideas that most problems are usually solved.Work CitedBosch, Karen A. & Kersey, Catherine C.(2007). Managing with class. The Autobiography of Mahatma Gandhi

The autobiography of Mohandas Karamchand Gandhi, subtitled The Story of My Experiments With Truth, focuses on Gandhi's struggles for non-violence and civil disobedience through the acts of Satyagraha, literally meaning â€Å"holding firmly to truth. † In each of the chapters, he talks about instances in life in which he had struggled with Truth, considering Truth being the ultimate source of energy. The question many might ask is: how can one who is so skinny, one who had to live with a stick throughout his struggles, get such energy? It was because of his experiments and the trials that Gandhi developed dietetics, non-violence, hydropathy, naturopathy etc. After finishing his studies in England, he came to South Africa where he changed from a typical lawyer to one who was remarkable. It's more surprising that with the ideologies he produced from studying law, eastern and western philosophy, he kept them all by his side and followed them to the extreme. He was conservative to h is thoughts in any situation and in following them perhaps, to some, inflexibly so.One reason I become overwhelmed by Gandhi is his simplicity, wearing a single dhoti (an Indian clothing) and living solely by vegetables. Even when he was or his son was on his deathbed, he insisted that eating anything other than vegetables was wrong. He considered that through those necessities — in line with his teachings — it is possible that one can live freely. This means one can live without food or drink, without anger or desire, if they are to follow a simple code of behavior. This book thus teaches one in practical life on how to live without any of the material needs. ? – â€Å"I cannot attain freedom by a mechanical refusal to act, but only by intelligent action in a detached manner. This struggle resolves itself into an incessant crucifixion of the flesh so that the spirit may become entire free. † – â€Å"That freedom is attainable only through slow and painful stages. † – â€Å"A reformer cannot afford to have close intimacy with him whom he seeks to reform – â€Å"he who would be friends with God must remain alone, or make the whole world his friend. – on actively forgiving sin: â€Å"Man, as soon as he gets back his consciousness of right, is thankful to the Divine mercy for the escape. † – â€Å"When such Ahimsa [non-violence] becomes all-embracing, it transforms everything it touches. There is no limit to its power. † – On monastic changes to his life: â€Å"Let not the reader think that this living made my life by any means a dreary affair. On the contrary the change harmonized my inward and outward life. It was also more in keeping with the means of my family. My life was certainly more truthful and my soul knew no bounds of joy. † ?

Acme Fireworks Prospectus Essay

Acme Fireworks is a fireworks retailer that sells fireworks, puts on ground display fireworks, and large aerial displays fireworks. Acme Fireworks has been a sole proprietorship since it began two years ago. At this time the owner is receiving inquiries as to Acme Fireworks ability to create fireworks displays on a regular basis. CITATION Rog12 l 1033 (Rogers, 2012). In anticipation of increased business, the owner of Acme Fireworks is in need of some information. This prospectus is going to inform the owner as to: Whether or not the business will be governed by common law or the Uniform Commercial Code. Analyze whether or not the owner has any actual contracts. Explain the potential personal liability to Acme Fireworks is someone is injured by a stray firework. Discuss different employment types while discussing the advantages and disadvantages of each type as it applies to Acme Fireworks. And finally, give suggestions as to why Acme Fireworks should no longer be a sole proprietorship. When it comes to contracts, it is important to understand that there are two different bodies of law that come into play, the Uniform Commercial Code (UCC) and the common law of contracts. The difference between the UCC and the common law contract can make a huge difference in the outcome of a contract dispute. This could be the difference between being able to collect punitive damages, discharge or modify a contract, be able to sue under breach of contract, and whether or not there truly a legally recognizable contract after all CITATION Gun12 l 1033 (Denton, 2012). It is important to understand the type of contract governed by each body of law. The UCC applies to the sale of goods and securities, and common law of contracts applies to contracts for services, real estate, insurance, intangible assets, and employment CITATION Gun12 l 1033 (Denton, 2012). If the contract should happen to be for both  the sale of goods and for securities, the dominant element would be in control of the contract CITATION Gun12 l 1033 (Denton, 2012). Should Acme Fireworks have contracts with the inquiring businesses, these contracts would be governed under UCC rule. The contracts would be for both goods and services with goods being the dominant factor of the contracts. There would be more fireworks than there would be personnel. Hence, this would be the reasoning for a UCC contract. In order for the owner to have valid contracts with inquiring businesses there are five elements that must be present in order for the contracts to be valid. First there must be an offer. An offer is an invitation for another to enter into a contract CITATION Rog12 l 1033 (Rogers, 2012).Then there is the need for acceptance. Acceptance is the acquiescence to enter into a contract CITATION Rog12 l 1033 (Rogers, 2012). Then there is consideration. Consideration is anything of legal value that is asked for and received as the price for entering into a contract CITATION Rog12 l 1033 (Rogers, 2012). Now there is legality. Legality is the extent to which the contract is legal and not against public policy CITATION Rog12 l 1033 (Rogers, 2012). Finally, there is capacity. Capacity is the mental competency to enter into a contract CITATION Rog12 l 1033 (Rogers, 2012). Considering Acme Firework’s new â€Å"contracts†; Was there an offer? No, there was not an offer. The businesses were making inquiries, asking questions trying to find out what Acme Fireworks could handle. Was the acceptance? No, there was no acceptance. There were no contracts offered, therefore nothing to accept. Was there consideration? No, there was no consideration. Pricing of the firework displays was talked about, but that was j ust information given to answer question f the inquiry. Is there legality? Yes, when the contracts are made they will be legal as they will not be against public policy. Is there capacity? Yes, there is capacity. It is safe to assume that the owner of Acme Fireworks and the owners of the other businesses are of sound mind and body therefore able to enter into legally binding contracts. So, did the owner have enforceable contracts? No, he did not. While there was legality and capacity; there was no offer, acceptance, or consideration present. Fireworks displays are beautiful and exciting, but they are also very dangerous. The operator of a fireworks display has a duty to fireworks are done in a safe way that does not injure spectators CITATION All13 l 1033  (Business, 2013). To successfully sue a promoter of a firework display, it must be shown that the promoter failed to keep spectators at a reasonable safe distance CITATION All13 l 1033 (Business, 2013). In order to sue the operator of a firework display it must be shown that the spectator was injured by the discharge of a fireworks or firework that did not explode properly CITATION All13 l 1033 (Business, 2013). Should an injury occur neg ligence by the operator is presumed, as the operator is in sole control of firing the fireworks. Essentially, Acme Fireworks is going to want any such liabilities to be the responsibility of the company and not result in personal liability. Being a sole proprietorship Acme Fireworks will be liable for all debts and claims against the business. A lawsuit of this type could be financially devastating. However, should Acme Fireworks take the time and effort to incorporate or to form a Limited Liability Company they would more than likely be protected to a significant degree from such personal injury CITATION All13 l 1033 (Business, 2013) Should these contracts come into being, Acme Fireworks will need to hire more employees. But which type of employee should Acme Fireworks employ? The full-time employee works regular and on-going, between 35-45 hours a week, which includes non-wage entitlements and benefits like paid holiday leave, sick leave, and long service leave CITATION ASU14 l 1033 (ASU, 2014). Part-time permanent work is regular and on-going, involves fewer hours than full-time and usually has set days or set hours. No benefits and entitlements are received by part-time employees. Casual work is on-going and involves irregular hours and hourly pay. Casual workers work on an as needed basis, which means that they work when they are needed CITATION ASU14 l 1033 (ASU, 2014). Th ere are no entitlements for casual workers since the entitlements are factored into 20% of the higher hourly rate that casual workers receive CITATION ASU14 l 1033 (ASU, 2014). Casuals usually receive hourly rates of pay based on a minimum 15% loading of normal or applicable hourly rates of pay CITATION ASU14 l 1033 (ASU, 2014). Fixed term or contract employees are hired for a fixed period of time for a specific project or to replace an employee on sick leave or paternal leave CITATION ASU14 l 1033 (ASU, 2014). This type of employee would need an agreement in writing that sets out the length of the employment contract. Fixed term employees are entitled to the same annual personal and other leave as  full-time employees, but on a proportional basis for the period of their employment CITATION ASU14 l 1033 (ASU, 2014) Piecework and commission only payment employees rather than being paid a wage or salary are paid by: Piecework – the paying f a specific amount for completing a specific task. Commission – the paying of a percentage for each sale made Retainer plus commission – the paying of a fixed amount plus commission. Should Acme Firew orks decide to hire more employees, my suggestion would be to hire casual workers. Casual workers do not expect to work all the time they work when they are needed. They would not have to give them any entitlements just work. Should Acme Fireworks become so busy that they are working everyday then they might want to get some full time workers. But, as of right now go with the casual workers. Acme Fireworks has been a sole proprietorship since it began two years ago. As a sole proprietorship all liabilities for finances and operations are on the owner. The owner’s personal property is tied to the business, so the owner assumes a risk against his personal property should the business experience financial hardship. Profits and losses of the business are reported through the owner and are taxed at the individual rate. The sole proprietorship entity is the easiest entity to set up, but the owner will probably have to sell the business to retrieve his investment. Should Acme Fireworks become a partnership? A partnership has two or more owners that share equal control, unless the partnership agreement says otherwise or the entity is set up as a limited partnership CITATION Phi14 l 1033 (Phillips, 2014). L ike a sole partnership, profits and losses of the business flow through the partners and are taxed at the individual rate. Operating partners assume risks, both legally and financially. Creditors can attempt to collect debts from the partner’s personal assets CITATION Phi14 l 1033 (Phillips, 2014). To recoup their investment the partner is required to sell his interest in the business. With the potential for devastatingly high personal injury claims, this entity would not be the one for Acme Fireworks. This entity jeopardizes the personal assets of the businesses owners. A corporation? A corporation can have an unlimited number of owners, known as shareholders. This business entity remains separate from the owners in legal and financial matters CITATION Phi14 l 1033 (Phillips, 2014). The profits and losses of a corporation are taxed at corporate rates, not individual rates. Should the  corporation realize a profit it is paid out to the shareholders who then report it as income and pay taxes on it at an individual rate CITATION Phi14 l 1033 (Phillips, 2014). Corporations are taxed twice, once at the time of profits and losses and then again when the shareholders realize the dividends. Or a limited liability company? This entity is a partnership and a corporation mixed together. Owners are protected from personal liability like a corporation, but enjoy the tax advantages similar to a partnership. The LLC would be the entity I would suggest for Acme Fireworks due to the ability to be free from personal liability and the ability to be taxed at the lower partnership rate. Poets' Expression of Fillings Essay Example | Topics and Well Written Essays - 250 words

Poets' Expression of Fillings - Essay Example Wordsworth, in his poem, I Wandered Lonely as a Cloud, describes the various aspects of nature and concludes by appreciating their presence saying; Similar romantic themes are focused on the works of Donne, Frost, and Shakespeare as well as the works of Bishop, Basho, and Hardy. Many stylistic devices including imagery, symbolism, and sarcasm formed the major styles that were used to convey a romantic message to the then society. A proper choice of words with accurate rhyming schemes in these poems creates an acute rhythmic pattern enhancing their musicality and bringing out the aesthesis. For instance, Shakespeare in his poem That time of year thou mayst in me behold expresses his love for nature in a rather loving tone cultivating a compassionate mood on the readers towards nature. He says; In conclusion, poetic works during the romantic ages focused on the romance derived from various sources. The association of nature with man's ability to gain satisfaction through it formed a major theme in most of the works during this period. The theme of romance in these poems can be addressed at two levels by splitting the fused twin focus of interpersonal love.

Enhancing Literature for students of English as second Language Research Paper

Enhancing Literature for students of English as second Language - Research Paper Example Research shows that education is a long prescription and a short on description and this statement holds true for literacy instructions given for English language learners or students who use English as a second language (ESL). ESL students will represent a wide range of cultures and language skills and are the easiest to take note of in schools as they are enter into classrooms without knowing how to have a conversation with other students in English. These students will remain silent in class as they are trying to adjust in the new environment and culture and this silent period presents a time of great discomfort for the students as they feel as if they do not belong. Teachers working with these students will require theories and conceptual models and frameworks that are aimed at ensuring that the students easily adapt in the new environment and that their learning goes on smoothly without language barriers affecting their success in education (Jimenez and Gersten, 1994). Teachers will require to incorporate comprehensive input, cognitive academic language proficiency and the natural language approach in the effort of making ESL students learn without language barriers interfering with their success. Research reveals that there needs to be a considerable amount of guidance and innovative ideas that will enable ESL students to adapt in the new environment and learn English, and this will make the classroom conducive for learning. (Jimenez and Gersten, 1994). Teachers are required to enhance the approach they use to educate ESL students so as to make their classrooms conducive for the great numbers of ESL students. There is a general increase in the number of ESL students in the United States classrooms, and this means that there are cases when teachers without training on how to teach them attend to these students. Teachers can be asked to teach students of Non-English backgrounds , and this presents a milestone as the students may not be able to read and writ e well in their native language or in English hence the need for special attention and programs aimed at improving the literacy learning skills (Jimenez and Gersten, 1994). Thus, teachers are faced with the task of building literacy, develop writing expression ability and enhance the growth of the English language for the student at the same time. This is extremely challenging for teachers, and even the most experienced ones may have problems in simultaneously building these capabilities. Factors Affecting Second Language Acquisition There are various factors that will affect students’ ability to acquire a second language despite the fact that students will have varying patterns, speed and acquiring styles. Some students will easily take off and become quickly conversant without much effort and for others this will present a huge challenge. Some students will continue to struggle with learning English despite being engaged in constant and lengthy periods of being exposed to t he language being learnt (English). Learner characteristics or personal traits affect the ESL students in their effort to acquire literal efficiency. These are the characteristics that are specific to an individual and they will include attitude, motivation, personality, learning styles and attitudes. Research shows that self confident students and those that have sociable personalities will have the courage to attempt verbal communication with other students and these interactions will make them to adapt easily to the new environment (Reid, 2002). Learner characteristics will affect how the student responds to instructions, which will influence the student’s ability to learn. Situational or environmental factors are concerned with issues that are external to the
